1. Agreement to Terms

By accessing or using PostcodAI ("the Service") at postcodai.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and PostcodAI ("we," "our," or "us"), operated from the United Kingdom.

2. Description of Service

PostcodAI provides property analysis and insights for UK postcodes, including:

• Property price statistics and trends
• Price per square meter (£/m²) analysis
• Crime data and safety ratings
• School locations and Ofsted ratings
• Energy performance data
• AI-powered property insights

3. User Accounts

3.1 Account Creation

To access premium features, you must create an account using our third-party authentication provider (Clerk). You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use
• Be responsible for all activities under your account

3.2 Account Termination

You may delete your account at any time through the account settings or by emailing support@postcodai.com. We may suspend or terminate accounts for violations of these Terms.

4. Subscription Plans and Pricing

4.1 Free Plan

• Searches: 3 free searches per month (per user/session)
• Features: Basic property analysis with limited insights
• Reset: Search limit resets on the 1st of each month

4.2 Premium Plan

• Price: £3.99 per month (billed monthly)
• Searches: Unlimited searches
• Features: Full access to all property analysis, AI insights, and premium data
• Billing: Automatically renews monthly until canceled

4.3 Payment Processing

Payments are processed securely by Stripe. By subscribing, you authorize us to charge your payment method monthly on the subscription start date.

4.4 Price Changes

We reserve the right to change pricing with 30 days' notice to existing subscribers. Price changes do not apply to existing subscriptions until renewal.

5. Cancellation and Refunds

5.1 Cancellation Policy

You may cancel your premium subscription at any time through your account settings or by emailing support@postcodai.com.

• Cancellation takes effect at the end of your current billing period
• You retain premium access until the paid period ends
• No automatic renewal after cancellation

5.2 Refund Policy

No Refunds: All payments are non-refundable. We do not provide refunds or credits for partial months, unused searches, or early cancellations.

Exception: Refunds may be issued at our sole discretion for technical issues that prevent service access for more than 3 consecutive days.

6. Acceptable Use

You agree NOT to:

• Scrape, copy, or download large amounts of data using automated tools
• Reverse engineer or attempt to extract our source code
• Resell, redistribute, or commercialize our data without permission
• Use the Service for illegal purposes or to violate any laws
• Circumvent rate limiting or access controls
• Share your account credentials with others
• Upload malicious code or attempt to breach security
• Impersonate others or provide false information

Violations may result in immediate account suspension or termination without refund.

7. Intellectual Property

7.1 Our IP

The Service, including its design, features, algorithms, and derived data (e.g., £/m² calculations, AI insights), is owned by PostcodAI and protected by copyright, trademark, and other intellectual property laws.

7.2 Third-Party Data

We use publicly available UK government data (Land Registry, EPC, Crime, Schools) licensed under the Open Government Licence v3.0. See our Data Sources page for attribution.

7.3 Your License

We grant you a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes only.

8. Disclaimers and Limitations

8.1 No Financial Advice

8.2 Data Accuracy

While we strive for accuracy, we do not guarantee that:

• Property data is complete, current, or error-free
• AI insights are accurate or applicable to your situation
• Price estimates reflect current market conditions
• Third-party data (government sources) is accurate or up-to-date

Property data is historical and may not reflect recent sales or market changes. £/m² calculations depend on EPC data availability (60-80% match rates).

8.3 Service Availability

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. We do not guarantee:

• Uninterrupted or error-free operation
• That defects will be corrected
• That servers are free from viruses or harmful components

We reserve the right to modify, suspend, or discontinue the Service at any time without notice.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• PostcodAI is not liable for any indirect, incidental, special, or consequential damages
• Our total liability is limited to the amount you paid in the 12 months prior to the claim (maximum £47.88)
• We are not responsible for decisions you make based on our Service
• We are not liable for third-party service failures (Stripe, Clerk, etc.)

This limitation applies to all claims, whether based on contract, tort, negligence, or any other legal theory.

10. Indemnification

You agree to indemnify and hold harmless PostcodAI from any claims, damages, or expenses arising from:

• Your violation of these Terms
• Your misuse of the Service
• Your violation of any laws or third-party rights
• Property decisions made based on our Service

11. Third-Party Services

Our Service integrates with third-party providers:

• Clerk: Authentication (governed by Clerk's Terms)
• Stripe: Payment processing (governed by Stripe's Terms)
• Anthropic (Claude AI): AI analysis (governed by Anthropic's Terms)
• Google Maps: Map display (governed by Google's Terms)

We are not responsible for third-party services. Your use of these services is subject to their terms and policies.

12. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data.

13. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last Updated" date.

Material changes (e.g., pricing, cancellation policy) will be communicated via email 30 days in advance. Continued use of the Service after changes constitutes acceptance.

14. Governing Law and Disputes

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Informal Resolution: Before filing a legal claim, please contact us at support@postcodai.com to resolve the issue informally.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force.

16. Entire Agreement

These Terms, together with our Privacy Policy and Data Sources page, constitute the entire agreement between you and PostcodAI.
